Description |
All firearms (rifles, shotguns, handguns) must be transferred througha Federal Firearms Licensee. An exception to this requirement is firearms manufactured before January 1st 1899. (and modern Black Powder replicas thereof).
These firearms fall under the category of private party transfers (with the exception of the black powder firearms) and therefore are subject to the following requirements and fees:
Handguns: $35.00 for each handgun transferred
Rifles & Shotguns: $35.00 for the first firearm and $10.00 for all subsequent firearms transferred from the same seller.
*The purchaser will be required to complete the California Department of Justice Private Party Transfer Paperwork including the ATF 4473 Federal Form.
*The purchaser will be required to provide a California Drivers License or California Identification Card.
*The purchaser will be required to provide a current and most recent copy of a utility bill proving that they are a resident of California.
*The purchaser will be required to provide a right thumb print.
*The purchaser will be required to, prior to taking possession of the firearm, provide a copy of the receipt for a Department of Justice approved firearm safety device or own a gun safe (must complete DOJ Gun Safe Affidavit).
*The purchaser of the handgun will be required to obtain or present a Handgun Safety Course Certificate, unless they are in an exempt category.
*The Purchaser of the handgun will be required to submit to a safe handling test.
*All Private Party Transfer firearms are subject to a 10 day waiting period prior to firearm pickup.
*If the purchaser fails the Department of Justice background check, the fees are forfeited, and at the discretion of the Auction Company, the next highest bidder will be contacted.
*Firearms that are not picked up within 30 days of the transfer date will require the purchaser to restart the registration process including payment of fees.
Note: The change in the law effective January 1, 2014 requires rifle and shotgun registration to be the same as handgun registration. Therefore, the previous circumstances that allowed 50+ year old rifles and shotguns (with the exception of those made before 1899 and/or black powder replicas) to transfer between buyer and seller in California without going through an FFL dealer is no longer valid.
